EUSR CAT1, HSG47 and the Burden of Proof

Proving Cable Avoidance Competence with EUSR CAT1, HSG47 & CDM

After a cable strike, the question is no longer whether your operatives were trained. It is whether you can prove it – and whether the training they received meets the standard the law actually requires, says Peter Ashcroft, founder of independent training provider Sygma Solutions.

When the Health and Safety Executive arrives on a site following a serious utility strike, the conversation moves quickly from what happened to what was in place beforehand. Risk assessments. Method statements. Permits. And – almost without exception – training records. The question the inspector is trying to answer is simple: was the operative competent to carry out that work?

For SHEQ managers, the uncomfortable truth is that ‘competent’ is not the same as ‘certified’. The two have drifted further apart in recent years, and the gap is where prosecutions live.

The legal framework, briefly

Two pieces of guidance and regulation set the floor. HSG47 - Avoiding Danger from Underground Services is the HSE's published guide on safe excavation around buried utilities. It is guidance, not law in itself, but it is what an inspector and a court will reference when assessing whether reasonable precautions were taken.

The Construction (Design and Management) Regulations 2015 – CDM – place the legal duty on the principal contractor and the employer to ensure that anyone carrying out excavation work is properly informed, instructed, trained and supervised. The regulations do not specify a particular qualification, but they do require that competence is demonstrable.

This is where evidence becomes everything. In practical terms, that evidence almost always takes the form of a recognised training certificate, a record of refresher cycles, and increasingly, some form of on-site competency check between formal renewals.

Why EUSR Category 1 Locate Utility Services has become the benchmark

EUSR Category 1 Locate Utility Services – the Energy and Utilities Skills Register's Category 1 cable avoidance qualification – has emerged over the past several years as the de facto industry standard for proving operative competence on cable avoidance tools. It is now mandated by most major utility companies and their tier-one supply chains as a condition of site access.

The qualification combines a multiple-choice theory assessment with a practical test on a live training rig, and the result is registered on the EUSR database, which means an inspector or a procurement team can verify it independently. That database registration is part of what gives EUSR Category 1 Locate Utility Services its weight as evidence. A laminated certificate in a file folder is one thing. A national database entry tied to a named operative is another.

However, it is worth being clear about what EUSR Category 1 Locate Utility Services does not do. It is not the most comprehensive cable avoidance qualification available. ProQual CAT1 covers significantly more ground on CDM, risk assessment monitoring, and Safe Systems of Work aligned with HASAWA, HSG47 and GS6. Sygma helped develop the ProQual CAT1 standard for that reason. But where a client mandates EUSR specifically, that is the qualification operatives must hold – and in most of the UK utilities and infrastructure sector, that is exactly what is mandated.

The competence gap between certificates

The harder question for SHEQ teams is what happens in the two-to-five-year period between certification and renewal. Most industry-accredited cable avoidance certificates are valid for three to five years before refresher training is required. In that window, behaviour drifts. Operatives revert to habits the course was designed to correct. The signal generator stays in the van. Pre-use checks get skipped.

The HSE has been increasingly explicit on this point in recent enforcement decisions: training that is not reinforced, audited, or revisited between formal cycles does not meet the duty of care that CDM imposes. On-site competency assessment – GPS-stamped, photo-verified, conducted on the operative's actual work site – is one of the more defensible ways to close that gap. What good looks like in a training record

For SHEQ teams reviewing their cable avoidance training programmes ahead of an audit or after a near-miss, a defensible record now looks broadly like this: a current EUSR CAT1 or ProQual CAT1 certificate for every operative carrying out excavation work, registered on the relevant database; a clear refresher cycle, with diaried renewal dates and a process for taking operatives off cable-adjacent work if a certificate lapses; on-site competency evidence between renewals, showing the trained behaviour is actually being applied; and a documented training provider with recognised accreditation, ideally one whose trainers are directly employed and qualified to TAQA standard.

None of this is a guarantee against a prosecution. But it is the evidence trail that turns a defence from "we sent them on a course" into "we trained them, we verified them, and we kept verifying them". For most SHEQ managers, that is the difference that matters.
